1. Acceptance of Terms

By accessing or using the Aivio website (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Aivio provides an AI-powered image generation platform that allows users to generate images using AI models. The Service includes both free and paid subscription plans.

Each subscription plan includes a certain number of credits that can be used for AI image generation. Credits are non-refundable and expire according to the terms of your subscription plan.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and current information at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Service.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Payments and Subscriptions

All payments are processed through Creem. By submitting a payment, you agree to pay the stated fees for the subscription plan you have selected. Fees are non-refundable except as required by law.

Subscription billing is recurring, and you will be charged automatically at the beginning of each billing cycle unless you cancel your subscription. You may cancel your subscription at any time through your account settings or by contacting us.

We reserve the right to change our prices at any time. Price changes will go into effect on the next billing cycle after the change is announced.

5. Intellectual Property

You retain ownership of all images you generate using our Service. By generating images with our Service, you grant Aivio a limited license to store and display your generated images as necessary to provide the Service to you.

The Service itself, including all software, code, design, and content, is the property of Aivio and is protected by copyright, trademark, and other intellectual property laws.

6. Acceptable Use Policy

You agree not to use the Service:

• For any illegal purposes or to violate any applicable laws
• To infringe on the intellectual property rights of others
• To attempt to gain unauthorized access to our systems or other users' accounts
• To interfere with the proper working of the Service

6.1 Prohibited Content

Aivio strictly prohibits the generation, upload, sharing, or distribution of the following content through our Service. This list is not exhaustive, and we reserve the right to remove any content we deem inappropriate:

• NSFW, sexually explicit, pornographic, or nude content of any kind, including AI-generated nudity, suggestive imagery, or content intended for sexual gratification.
• Child Sexual Abuse Material (CSAM) or any sexual or suggestive content involving minors. Violations will result in immediate account termination and reporting to the National Center for Missing & Exploited Children (NCMEC) and relevant law-enforcement authorities.
• Non-consensual intimate imagery, "deepfakes," or any sexualized depiction of a real person without their explicit, verifiable consent.
• Content depicting graphic violence, gore, self-harm, suicide, or torture.
• Content that promotes terrorism, hate speech, harassment, or discrimination against any individual or group based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics.
• Content designed to defraud, deceive, or impersonate another person or entity, including phishing, scams, or misleading political content.
• Content depicting illegal activities such as the manufacture or sale of controlled substances, weapons, or counterfeit goods.
• Content that violates any individual's privacy, publicity, or intellectual property rights.
• Malware, viruses, or any code intended to disrupt, damage, or gain unauthorized access to systems or data.

6.2 Content Moderation & Enforcement

We use a combination of automated content filters (input prompt screening and output image classification) and human review to enforce this Acceptable Use Policy. We reserve the right, at our sole discretion, to:

• Block or refuse any prompt or output that violates this policy
• Remove violating content from our Service and storage
• Suspend or permanently terminate accounts found in violation, without refund
• Report illegal content (especially CSAM) to the appropriate authorities
• Cooperate with law-enforcement investigations as required by law

6.3 Reporting Violations

If you encounter content on our Service that violates this policy, please report it immediately to JayFang1993@gmail.com. We investigate every report and act on confirmed violations within 24 hours.

7. Disclaimer of Warranties

Our Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, error-free, or that it will meet your specific requirements.

8. Limitation of Liability

In no event shall Aivio be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service ceases immediately. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
